What is prohibited under the FCPA?

(a): The FCPA prohibits any covered entity from paying money with the intent to wrongfully influence the recipient to abuse his or her official position or for the purposes of wrongfully directing business to the payor. The FCPA only covers payments to public officials, not to private persons. It is an affirmative defense that the payment was lawful under foreign law.
