China Law Digest - May 19, 2008

Dear Readers,

The new Law on Mediation and Arbitration of Labor Disputes of the People’s Republic of China, which took effect on May 1, 2008, strengthens the rights and abilities of employees to request legal intervention in an employment dispute. This week’s China Law Digest presents a summary of the main changes of the Law on Mediation and Arbitration of Labor Disputes as well as the text of the new law in English.

Lehman, Lee & Xu has extensively advised on issues concerning the employment of foreign and Chinese individuals in China. We assist our clients in negotiating and drafting employment contracts, advise them on governmental health and safety requirements and employee benefits, and assist with employment-related dispute settlement, including arguing on our clients’ behalf in front of labor arbitration tribunals.

We would also again like to express our deepest sympathy to those who have suffered as a result of the earthquake in Sichuan province on Monday, May 12, 2008. For our readers who would like to support earthquake relief in the disaster area, the following organizations are currently accepting donations:

- Red Cross Society of China

- China Soong Ling Foundation

- Oxfam Hong Kong

- Mercy Corps

- World Vision

Lehman, Lee & Xu will support disaster relief efforts by donating RMB 100,000 to the Beijing Lawyers Association’s earthquake fund. We welcome any questions you may have about donating to earthquake relief at mail@lehmanlaw.com.

Best regards,

Edward E. Lehman
