Selected Software-Related Invention Patents

Vol. 2 , No. 1 - January 14, 2002

Welcome to China E-ventions. Keeping up with technology is difficult enough, but learning about new trends in patent examination methods and policies in different countries is a monumental task. One area of keen interest these days involves a particular classification of patent that goes by many names: business method patent, Internet patent, software patent, and so on - in China, "software-related invention patents". To be clear, many of these names have distinct definitions in certain jurisdictions; however, their similarity has caused great confusion for international practitioners.

The purpose of this newsletter is to provide the foreign patent practitioner with China patent news as well as a regular snapshot of how China's State Intellectual Property Office (SIPO) is approaching these kinds of inventions.

Chinese Register More Patents

China has witnessed an increasing number of patent applications and approvals since the adoption of the Patent Law more than 20 years ago.

At a national patent working meeting, which started December 18, 2001 in Beijing, the Director of the State Intellectual Property Office, Wang Jingchuan, revealed that up until last year, the total number of patent applications maintained an annual growth of 18 per cent.

From the passage of the Patent Law in 1985 to the end of November of 2001, three kinds of filed patent applications reach 1.351 million in number, and nearly three quarters of a million patent applications have been approved.

In this year alone, 12 projects awarded with Patent Prizes have generated sales volumes of nearly RMB 9 billion, or roughly over 1 billion US dollars.

Patent Applications Increase Sharply in Shanghai

The patent office of Shanghai, the biggest industrial center in China, received 10,384 patent applications from local companies, research institutions and schools of higher learning in the January-October period, a year- on-year increase of 33.5 percent.

Local patent officials said Shanghai has been stepping up efforts to protect intellectual property rights (IPR) and innovations according to the country's laws and regulations.

The Shanghai Municipal government has cited 96 new technologies this year.

Many of the technologies cited this year have yielded huge returns for the IPR owners and their buyers, said an official with the Shanghai Municipal government.

A patented technology for rolled steel production developed by Gao Yutian and other experts with the Baoshan Iron and Steel Company was given a first-class prize.

The technology has increased the annual output value of the company by RMB 2.4 billion (292 million U.S. dollars) each year, adding a total of RMB 1.3 billion (158 million U.S. dollars) in pre-tax profit during the past three years.

Overseas Applications Encouraged

The Chinese Government is planning a way to help domestic academic and industrial researchers seek patent protection abroad. The State Intellectual Protection Office (SIPO) said it will announce detailed measures soon.

"High-tech research findings in China that have huge potential on the world market must be protected," said SIPO commissioner Wang Jingchuan. Wang said in a work report presented on the opening day of a three-day National Patent Conference that the efforts will help cushion the challenges China faces now that it is a member of the World Trade Organization (WTO).

In 2001, Chinese applicants delivered 1,026 applications for patent protection in foreign countries, almost three times the average of the prior 15 years, SIPO statistics indicate. The 2002 figure is expected to double that of last year.

"We have achieved a lot in the past two years, but we are still lagging behind in comparison with developed countries," Wang said.

Vice-Premier Wen Jiabao sent a congratulatory letter to the conference on Tuesday, calling on the nation to step up efforts to protect intellectual property rights.

Wang's office will work with central and local authorities to beef up intellectual property rights in China and abroad. Authorities of various industries and enterprises also will be involved, Wang said.

Wang said his office and other departments will select some key research projects in the industries that are of key importance to the State's economic development. They will be the focus of special protection efforts.

He said China's new legislation on intellectual property rights meets the standards set in the WTO, so now the goal must be to beef up enforcement.

He called for more efforts to deepen awareness of technology innovation and patent protection.

Although the country has made significant progress in patent protection since it implemented the Patent Law in 1985, some companies and research institutions still ignore patent applications.

"To help domestic enterprises meet global competition, we must make them know how to combine intellectual property rights protection with technology development," he said.

Intellectual Property Protection to be Reinforced After WTO Entry

A top Chinese official has called for more work to protect intellectual property rights, one of China's key commitments as a new member of the World Trade Organisation, State media recently reported.

"After entry to the WTO, work on intellectual property rights is important and urgent," Vice Premier Wen Jiabao was quoted by the People's Daily newspaper at a national meeting.

China has promised to abide by the WTO's agreement on Trade-Related Aspects of Intellectual Property Rights, known as TRIPS.

In a recent case widely reported by State media, U.S. chemical giant DuPont won a patent lawsuit against a Chinese pesticide company. Despite such individual victories, foreign companies say China has a long way to go.

In a survey released last December, 54 percent of Japanese-funded firms in China say they have suffered losses from fake products.

Some 70 percent of nearly 700 companies surveyed said Chinese firms had infringed on their product designs or trademarks, according to the joint study by Japan's economic ministry and the government-backed Japan External Trade Organization.

Vice Premier Wen said protection of IPR was at the heart of global competition, adding Chinese companies should seek to develop original products with their own patents.
