How is criminal liability decided?

The seller and manufacturer of a defective product may be subject to criminal liability, for example if they sell products and are aware that the quality does not meet mandatory quality standards or if they pass off fake products for genuine ones. Other circumstances are if the products manufactured or sold cause personal injury or death due to a defect. In order for such an act to be regarded criminal the seller or manufacturer must have acted on criminal intent or negligence.
