You can not file a patent for a plant variety. There are, however, particular Regulations in China concerning plant varieties. In 1997, China implemented the "Regulations of the People's Republic of China on the Protection of New Varieties of Plants". China became a member state of the International Union for the Protection of New Varieties of Plants (UPOV) on April 23, 1999, and began to receive applications for new plant variety rights.
