SIPO Publishes Several Provisions On Patent Applications By Taiwan Compatriots

The SIPO has recently published Several Provisions on Patent Applications by Taiwan Compatriots which shall take effect as of 22 November 2010. Where an applicant from Taiwan, within 12 months from the date on which it files for the first time its invention or utility model patent application or within 6 months from the date on which it files for the first time its design patent application, to the administrative department of patents of Taiwan, files a patent application to the SIPO in respect of the same subject matter, it may claim a right of priority for its prior application in Taiwan. Where an applicant claims a right of priority in Taiwan, the date of application of its prior application should be after 12 September 2010 (inclusive). An applicant may claim one or more rights of priority in Taiwan in one application; where it claims more than one right of priority in Taiwan, the priority period in Taiwan for such application shall be calculated from the date of application of its earliest prior application.
