SAIC Publishes Trademark Agency Rules

The State Administration for Industry and Commerce has recently published their “Measures on the Administration of Trademark Agencies”. Grace Wang, Trademark Agent at Lehman, Lee and Xu, has described this as “the latest move by the SAIC to standardize trademark agency services whilst simultaneously protecting the lawful rights of both trademark agencies and their clients.” These new regulations declare trademark agencies as organizations which represent their clients in filing trademark registration applications on their clients’ behalf, or offer any other trademark related legal services. In addition, the Measures prevent agencies from representing multiple parties within the same trademark case, as well as prohibiting the employment of a trademark practitioner by more than one trademark agency at any given time.
