Rules On Supervising Establishment Of Criminal Cases Issued

The Supreme People's Procuratorate and Ministry of Public Security have jointly published the "Provisions concerning the Supervision of Opening Criminal Cases (Trial)" which will become effective throughout China from 1 October 2010.

 

The Provisions, with the intention of assuring the proper use of the procuratorates' power, introduce a mechanism handling criminal cases wrongfully or unlawfully opened by the procuratorates as well as criminal cases which should have been opened but are ignored. In the later case, where a complaint is filed or an offence is discovered, the injured party or his / her lawfully appointed agent, close relative or other authority in charge of enforcement believes that the authority of public security in question should charge the suspect in question or transfer the case for further investigation and such party files a request with the procuratorate, the procuratorate in question must accept the request and conduct investigations.
