Edward Lehman, Insolvency Law in China: A Seminar for Professional Practitioners interested in China related issues by LEHMAN, LEE & XU China’s premiere bankruptcy practice Group (see www.lehmanlaw.com) May 14 2012

Bankruptcy and insolvency in China are complex areas of law composed of a number of complementary and sometimes competing and conflicting pieces of legislation, both with the Chinese Central Government, China provincial governments, and China local governments, as well as the Chinese labor authorities that have developed and evolved over the course of the last twenty-five years. The years Edward Lehman (elehman@lehmanlaw.com) has been acting as a legal professional resident in mainland China (Shanghai and Beijing) on all sorts of bankruptcy, insolvency and reorganization matters “on the ground” with businesses.

China has undergone the greatest economic transformation in the history of the world, it is the beneficiary of billions of dollars of foreign direct investment so foreign business ties are inexorably linked to China and foreign businesses. Businesses go through reorganization in other companies and it affects the china subsidiary, many such issues have developed between China and foreign countries as a result of this abundance of foreign direct investment in China. All this has created a need for bankruptcy practitioners in China and around the world to develop a practical understanding of the China bankruptcy and insolvency legal system. Edward Lehman, China longest serving managing director will present this master class to legal peers current in the matter at their offices in the China Ministry of foreign Affairs Liangmaqiao Diplomatic Compound (beside the USA Embassy).

Insolvency Law in China: A seminar for China and foreign professional practitioners provides an excellent introduction to the China judicial, China regulatory, China policy, and an China legislative frameworks that characterize China’s unique and challenging legal and administrative system, and touches on the major bankruptcy and insolvency themes that Edward Lehman has dealt with first hand with some of the world’s largest companies in mainland China and some of China’s State Owned Enterprises —China bankruptcy, China restructuring, China receiverships and detailed case studies—that cross all types of insolvency proceedings both legal and administrative under China’s laws, regulations, and policies. The China law seminar by Edward Lehman covers China’s key China insolvency statutes, including the China bankruptcy and China insolvency laws, regulations, and polices, Supreme Court interpretations and the impact on companies’ creditors to Chinese entities and impact on the Chinese “legal person” for entities under these procedures (criminal and civil). Further Edward Lehman will discuss a number of other laws that affect insolvent China companies, their China creditors and other shareholders/ stake holders. This master class on Insolvency Law in China is an invaluable opportunity for both China and foreign practitioners who wish to develop a solid understanding of the law and China bankruptcy and reorganization practice. Edward Lehman will present in Chinese and English, and provide case studies.
