CNNIC Amends Its Policies on Wireless Domain Disputes

On July 29th 2010, China Internet Information Network Center (“CNNIC”) updated its policies on domain disputes by issuing the new Wireless Domain Name Dispute Resolution Policy (the “Policy”). The Policy is an amendment to the former disputes policy promulgated in 2006, and is to come into effect on August 29th.

 

Wireless domain system is designed for mobile device users to access to the Internet. Such domains are under the administration of CNNIC and can be purchased by individuals or corporations.

 

The new Policy further specified resolution on wireless domain disputes mainly from two aspects. On the one hand, it is no longer deemed to be “malicious” to sell a domain, unless it is so as to obtain unfair benefits. On the other hand, if the domain is used in good faith or non-profit, or gains popularity through uses, the domain holder is to be protected in the resolution. Additionally, the Policy also imposed a time limit of two years for such disputes.

 

“The new Policy alters CNNIC’s attitudes towards wireless domain disputes, which was formerly inclined to the complainant,” said Edward E. Lehman, Managing Director of Lehman, Lee & Xu. “The revision is to offer more protection for domain holders’ legitimate interests,” she added.
