The Beijing Haidian District People’s Court has recently heard a lawsuit filed by Beijing Founder Electronics Co., Ltd. (Founder) against Procter & Gamble (Guangzhou) Ltd. (P & G) and Carrefour Commercial Co., Ltd. (Beijing) for font copyright infringement. The plaintiff alleged that it owned the copyright of the font which was used on the exterior package of 55 models of products manufactured or sold by the defendants, so it requested P & G to immediately stop the use and destroy all products using the font, Beijng Carrefour shall cease selling the products with the aforesaid font at once, and the two defendants shall publicly apologize, eliminate the effect and pay compensation for economic losses. After hearing the case, the court held that Qian computer font and its corresponding word library software developed independently by Founder satisfied the characteristics of art works by China’s copyright law. If the font of the word library is copied or used as a whole by others, especially if such use consists of the copying or embedding of the software, it shall be considered infringement. However, the request of protecting a single word as an independent artwork cannot be justified at many aspects, and it is difficult to determine the criteria. In summary, the court decided to reject all claims made by Founder.
