White Collar Criminal Defence & Counseling Solutions
The White Collar Criminal Defence and Counseling Practice is principally responsible for counseling and defending clients of the Firm who have been victimized by or implicated in alleged violations of a broad array of civil, criminal or regulatory provisions. We commonly represent corporations, as well as their officers and directors, in connection with investigations of potential wrongdoing by Chinese Procurate and regulatory authorities. We regularly advise Chinese corporations and Foreign Invested Enterprises as to the most effective means to mitigate the impact of any detected misconduct, and to implement or modify corporate compliance programs to minimize the likelihood of recurrent problems.
Although we attempt to negotiate favourable resolutions wherever possible, we vigorously defend our clients at trial in Chinese Courts and before the Chinese regulatory authorities when it is in their best interests to do so. Our attorneys have significant expertise in assisting clients with respect to matters relating to government contracting, political corruption and related ethical matters, State Food & Drug Administration and safety regulatory compliance, securities fraud and criminal tax investigations.
Our work includes: - Conducting internal investigations on behalf of some of China's largest corporations, as well as state and municipal bodies;
- Counseling corporate clients on the most appropriate means to redress and mitigate the consequences of prior employee misconduct, and to implement an effective compliance program to minimize the likelihood of future misconduct;
- Representing corporate and individual clients in defence of or in relation to People's Procuratorate investigations and other governmental investigations;
- Representing corporate and individual clients at trial in defence of criminal and/or civil charges; and
- Handling appellate litigation.
