Dispute Over "Tianxiayaocang" Trademark

It is reported that Beike lodged a suit to Lanzhou Intermediate People's Court against Development Bureau on the ground of unfair competition. Beike claimed that it was the legal owner of the "Tianxiayaocang" trademark. The Development Bureau published an article entitled "Shaanxi's Successful Registration of Tianxiayaocang Trademark" on relevant media, which made consumers believe by mistake that it had obtained the "Tianxiayaocang" trademark in the relevant pharmaceutical category, thus resulting in inquiries and questions from many of Beike's clients and causing negative impact on Beike. Beike believed that the defendant's act fell within improper publicity and went against the provisions of unfair competition law; therefore it requested that the court order the defendant to stop infringement and pay compensation of more than 50,000 yuan for its economic loss. The case is pending further trial.
